Terms & Conditions
These Terms & Conditions apply to services provided by Lyons Den Fitness, including personal training, coaching, personalised programming and other fitness-related services.
By booking, purchasing or participating in a Lyons Den Fitness service, you acknowledge that you have read, understood and agreed to these Terms & Conditions.
Services
Lyons Den Fitness provides fitness and coaching services that may include:

Strength and technique coaching

Fitness assessments and progress monitoring

Group fitness services where available
The specific services provided will depend on the service or coaching arrangement selected by the client.
Client Responsibilities
Clients are responsible for providing accurate and relevant information that may affect their ability to participate safely in exercise.
Clients should inform Lyons Den Fitness of any injury, illness, medical condition, medication, physical limitation or change in circumstances that may affect their training.
Clients are also responsible for following reasonable instructions regarding exercise technique, equipment use and safety.
Health & Exercise
Participation in physical activity involves inherent risks, including the possibility of injury.
Exercise programs and coaching are provided based on the information available to Lyons Den Fitness and within the professional scope of practice of a personal trainer.
Lyons Den Fitness does not provide medical diagnosis, medical treatment, physiotherapy, dietetic services or other healthcare services.
Where appropriate, a client may be advised to seek clearance or guidance from a suitably qualified healthcare professional before beginning or continuing particular activities.
Results & Client Commitment
Lyons Den Fitness is committed to achieving meaningful results for every client through appropriate programming, coaching, accountability and ongoing support.
Results are a shared responsibility between coach and client. Lyons Den Fitness is responsible for providing the plan, guidance and support required to progress toward the client's agreed goals. The client is responsible for consistently following that plan and completing the actions required of them.
Expected progress depends on the client:

Attending and participating in scheduled training sessions

Completing prescribed training outside coached sessions where applicable

Following agreed nutrition and lifestyle strategies

Communicating honestly about training, recovery, nutrition, injuries and other relevant circumstances

Applying coaching advice and agreed changes

Maintaining reasonable consistency over the time required to achieve the goal
Where a client consistently follows the agreed plan but is not progressing as expected, Lyons Den Fitness will assess the available information and make reasonable adjustments to the training or coaching approach.
Lyons Den Fitness cannot be responsible for a lack of results where the agreed plan has not been followed consistently, where relevant information has not been disclosed, or where circumstances outside the scope or control of the coaching service materially affect the outcome.
The commitment of Lyons Den Fitness is simple: if you commit to the process, we commit to doing everything within our professional scope to help you progress toward your goal.
Bookings
Personal training sessions and other appointments are subject to availability and must be booked through an approved Lyons Den Fitness booking method.
Clients are responsible for attending sessions at the agreed time.
Cancellations & Rescheduling
Cancellations, rescheduling, late cancellations and no-shows are governed by the separate Lyons Den Fitness Cancellation Policy.
Clients are encouraged to review this policy before making a booking or purchasing an ongoing coaching service.
Payments
Fees are payable according to the service, package or coaching arrangement selected by the client.
Where a client has entered into an ongoing weekly subscription or coaching arrangement, payments will continue according to the agreed billing schedule unless the arrangement is cancelled, suspended or otherwise varied by agreement.
Payments may be processed through third-party payment providers, including Square.
Clients are responsible for ensuring that their payment information remains current and that sufficient funds are available for scheduled payments.
Failed Payments
If a scheduled payment fails, Lyons Den Fitness may contact the client to arrange payment.
Access to training sessions, programming or coaching services may be temporarily suspended while an account remains unpaid.
Refunds
Refund requests will be considered according to the nature of the service purchased, the services already provided and applicable Australian consumer law.
Nothing in these Terms & Conditions is intended to exclude, restrict or modify any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law.
Ongoing Coaching & Subscriptions
Ongoing coaching arrangements may include more than attendance at individual personal training sessions.
Depending on the service selected, coaching may include programming, communication, accountability, progress monitoring, planning and reserved training time.
Failure to attend an individual session does not automatically suspend or cancel an ongoing coaching arrangement.
Personalised Programs
Exercise programs provided by Lyons Den Fitness are developed for the individual client for whom they were created.
Clients should not distribute, reproduce, sell or provide their personalised program to another person for commercial use.
Programs designed for one individual may not be appropriate or safe for another person.
Online Coaching
Clients participating in online coaching are responsible for ensuring that they have an appropriate and reasonably safe environment in which to perform their training.
Clients should follow the exercise instructions provided and contact Lyons Den Fitness if they are uncertain about an exercise, experience pain or believe an exercise may not be appropriate for them.
Personal Property
Clients are responsible for their own personal belongings while attending training sessions.
Lyons Den Fitness is not responsible for loss, theft or damage to personal property except where liability cannot lawfully be excluded.
Conduct
Clients are expected to behave respectfully toward Lyons Den Fitness, other clients, gym staff and members of any facility in which services are provided.
Abusive, threatening, discriminatory, dangerous or seriously inappropriate behaviour may result in a session or coaching relationship being terminated.
Third-Party Facilities
Some Lyons Den Fitness services may be delivered within a third-party gym or training facility.
Clients must comply with the applicable rules, safety requirements and conditions of entry of that facility.
Lyons Den Fitness does not control the operation, availability or policies of third-party facilities.
Website Information
Information provided on the Lyons Den Fitness website, social media accounts or other general educational materials is provided for general fitness and educational purposes.
It should not be treated as individual medical or healthcare advice.
Intellectual Property
Unless otherwise stated, original Lyons Den Fitness website content, written materials, exercise programs, branding and other business materials remain the intellectual property of Lyons Den Fitness.
They may not be reproduced, distributed or used commercially without permission.
Privacy
Personal information is handled in accordance with the Lyons Den Fitness Privacy Policy.
Changes to These Terms
Lyons Den Fitness may update these Terms & Conditions from time to time to reflect changes to services, business practices or legal requirements.
The current version will be made available through the Lyons Den Fitness website.
